Its supposed to get 40-44 mpg but on a full tank of 12 gallons i am only able to get 360 miles out of the tank. should i file a lawsuit or return the car or what?

Right to lawsuit. Really?

There are many complaints about the Prius not meeting the stated mileage. Some of it may be the car but I'm betting much is with how it's operated/driven and where, just like any car. Which mode (Eco, Power, EV) are you using? How long have you had the car? Where are you driving (mostly short city trips, long highway cruises...). Do you live in hilly or flat country?

Hybrids can be very efficient (esp the Prius)...but you can't drive them like a regular car to maximize the savings. Very light throttle and braking, keeping the engine from starting at low speeds, lots of hills, etc can all contribute to what numbers you get.

Doesn't this one have the little computer that tells you when you are doing everything right? And different operating modes...like a normal and an eco?

Remember....the EPA numbers are only an estimate.
