Deck ledger on chimney

i have a chimney that extents out that is resting on my concrete foundation walls. Reading the code on decks show framing around a chimney. Since this is on the foundation is is acceptable to attach a ledger to the rim joist of the chimney? It was currently attached to it and Iím in the middle of tearing out the old deck and rotten wood.

That code includes hollow masonry, so if those are concrete blocks the answer is no. If it is poured concrete, which it looks like it is, then it is okay. But you need to follow the ledger attachment schedule (figure 19 in the DCA6) and use 1/2" concrete anchors. You obviously also need to flash the ledger correctly under your siding, so your bottom row of siding will have to come off.

The ledger will be higher then the concrete, so can I attach to the rim band above the concrete. Yes everything will have to be flashed correctly.
