bath remodel - toilet

Hello All
I am having a bath remodeled. The problem is the toilet. My contractor installed it unlevel (don't ask) He says the floor is not level. (I checked, it is out maybe 1/16 of an inch). The toilet is a one piece Kohler unit. However the tank/toilet is out of level more - egual to 1/4 of an inch. Logically I can't make sense out of this. I would assume the most the toilet would be out of level is 1/16. Also I do not know if a new flange was installed over new tile or if the new tile was brought up to the existing flange. I am not sure if this makes a difference. I just want a level toilet and think this shouldn't be hard to do. The contractor doesn't want to shim because it won't be secure and lead to problems down the road. I am at a loss for possible causes and solutions. Should I have remove and see if it is a problem with the flange? possible defect in toilet unit? What are approaches to this problem. I don't want to be a pain in the ass to a contractor but I want my toilet level HELP

Unlevel toilet
