temporary electric

I have a question about a temporary electric meter. Have a guy that the service line is coming in from the bottom and he has used the meter box before and had it coming in from the top. He says he doesn't have to pull out the unused and not covered wires. is there anything in the code book that say something like unused wires cannot be inside a panel box.

Anything would be great

The wires that are not being used MUST be removed,otherwise they will be made hot along with the new feeds.I wouldn't trust that guy to change a switchplate.
