Garage subpanel

I have a detach garage that has a subpanel with #6 stranded wire (that runs around 65 feet away from the main panel)and a 60 amp breaker in the main panel, There is a small box with two double 20amp breaker for 4 circuits. Now my question is if I could change the box for one with more capacity so I could install a tankless water heater that requires a 40 amp two pole breaker with #8 wire. Please someone could help me. I forgot I'm going to convert the garage into a one bedroom apt. Thanks in advance.

Yes you can replace the panel with a larger one as long as you have a four-wire feed between the house and the garage (two hots, neutral and ground). If the old feed has only three wires, it is legal as-is, but cannot be changed unless you replace it.

Do you have a conduit between the buildings with #6 individual wires or is it a direct burial cable like UF-B?
