Electrical Swich not acting like I thought it would

In the attached pic the electrical switch provides power to lights when the switch is set to off (down), turns power off when switch set to on (up). If it wasn't marked I'd guess the switch is just turned upside down. But since it is marked on and off how does this happen?

This is in a commercial building with no other switch controlling the lights. The switch itself only has to connection points.

Mods, you can delete this thread, for some reason it is now acting appropriately. For the life of me I can't figure out why. I did not change anything.

I also am 101% sure it wasn't working correctly before.....

That appears to be and old switch. It may be going bad. I'd suggest replace it.
