Young maple tree hit by hard freeze - still growing down low

I planted a maple (autumn blaze) last summer. It did good all winter, leafed up nice in the spring then we got a freak hard freeze frost. The leaves all changed and fell off.

I was about to go dig it up to return it under warranty but then saw it had new growth under the plastic tube I had protecting the stump.

A few months later I have a lot of new growth at the ground. Almost looks like a shrub.

My question is should I cut the dead trunk off, or leave it? (It's about 8ft tall, maybe 1.5-2" diameter).

I'm also assuming I should tie the new growth to encourage it to grow up, more than out?
