Clear title from a divorce

During his divorce, my father-in-law was awarded sole title to the house that was in his and his now ex-wife’s name. The house (located in Florida) was titled His and Hers. Now he wants to sale the house, does the court filing on the divorce decree suffix to prove his sole ownership and a clean title to the buyers? I imagine that he would have trouble getting his ex to sign any deed transfer papers.

I went thru the same thing 25 yrs ago in fla. She should have signed a quick claim deed as part of the divorce. It would then have been registered with the state.

Does he still have a copy of the divorce papers? Is the divorce lawyer still around? What does the deed state?

Cool divorce

If your judgment of divorce states you get the house as part of the divorce or property settlement, all you should need to do is file with the register of deeds, a true copy of the divorce. That should take care of it.
