Any signs of fluid leaking around/under the tranny? Sounds to me like the tranny is going bad, unless you see a sign of a leak.

there is no signs of any leaking that was my first thought. what would cause it to work fine after sitting for a while.

could the fluid need to be changed? in the manual it says there is no service or maintance needed.

Hydro tranny's run hot as it is but you do not want it to overheat. Check for grass debris build-up on top of the tranny and clean off, if any. Overheating will cause cavitation of the oil and you will lose necessary pressure internally.
