Proper venting

Is it nessecary to vent a toilet if the stack is less than 5' from the toilet?

Depends on your local code, I would think so.

What is the "stack" you are referring to? If it is a waste stack coming down from an upper floor, that is not a vent, and cannot be considered as the vent for the toilet. You cannot "wet vent" between floors.
