roof leak, and when to call homeowners vs home insurance

Have been living in a home for past 2 months. Today had a rain storm and found water dripping in the closet doorway (it was dripping from door frame of the closet). The wooden floor underneath appears weakened as well. I'm not sure how water is getting in since there is no staining of the walls in the room. This tells me this was an issue before (but wasn't disclosed at time of sale).

Should I contact home warranty purchased with the home? Or home owners insurance? Or get an independent contractor to look at this?

If there is a HOW, call them first and let them deal with it. You may want to go ahead and call in a contractor of your choice to look at it too, just to confirm the fix. The HOW may allow you to call in YOUR contractor, and if so, you will already have his estimate on hand for them.

called HOW, they are covering roof repair up to $1000 and allowing me to choose my own contractor.
They are not covering "water damage" of any kind.

The water leak is not new, given that the wooden floor where I saw the water is noticeably soft compared to rest of the floor.

At this point is this an attorney who handles this situation? To decide how to cover this non-disclosed water damage?

It can't hurt to have your lawyer check it out. May depend on how contract is written but I not a lawyer.

Can you 'prove' is some way that the seller's knew about the water leak and damage inside a closet? Just because the floor is soft(er) - with no other visible damage, doesn't prove the previous owners were aware. If the damage was 'missed' by your home inspector, maybe it wasn't there for the homeowner to see either. It would help your case if you found someone to confirm the sellers knew about the damage, i.e. Contractor and declined the repair hoping no-one would notice.

Home warranty, though minimal is the way to go, albeit minimal.

Was there a Home Inspection ?

If so, then s/he probably carried E&O Insurance for what was missed.

Most E&O only covers the cost of the inspection. Great job to have. Miss things that cost the buyer thousands, and you are out $200.
