Birds in roof

Underneath the last shingle, near the gutter, there's a wide open space that birds have nested in several places each year. I can reach my hand under the shingle for about 6 inches or so. Is this roof up to code? If so, what can be done to keep them out?

You really need to fix the fascia board, or the birds will keep roosting there. And make sure that the hole is thoroughly cleaned of all 'debris' the birds left behind - as well as repair any rotted out wood. Might as well get it over with all at once. Keep in mind that bird doo can be rather toxic, either get someone to clean it out for you that is trained or research it on the web . . . there are some really nasty diseases from bird droppings, it's not something you want to take lightly.
