DP 25 amp breaker acceptable on a #12 wire/20A cable for water heater?

A fresh-out-of-electrician-school graduate connected a DP 40A breaker to a Dual 4500w/240v 40 gal. water heater installed on a #12/20A cable. Amp draw is 18.75A.

I'm confident that 30, 35, or 40 (doubtful about 40), is appropriate for this model, so was thinking that 35 for the compressor would be Ok until after the 4th holiday?...
