Water heater vent code

Can someone point me to the NJ code for water heater atmospheric vents.

Specifically, when can you use 3 inch vs 4 inch pipe.

Existing is 3 inch. Replacing with same size tank, and installer insists that in NJ 4 inch is "the law".

This is a 50 gal. 40K BTU tank being replaced with another.

Ahhhh..... musical thread. I was going to move your first to here and then it was abandoned.

It is so hard to get information on the NJ Gas codes. I had an older copy and can't find it. On a 40 gallon tank.... I believe 3" is ok but on a 50 gallon tank..... bigger burner..... 4" is now required. However..... it is still up to the AHJ. He may request 4" routinely.

Code is local, it's always best to check with the local AHJ.
